The trial for Bellaire Police Officer Jeffrey Cotton, who is charged for the shooting of Bellaire resident Robbie Tolan, is scheduled for May 3, but may be getting pushed back for the fourth time.
Cotton is accused of shooting Tolan on Dec. 31, 2008 in the front lawn of his Bellaire home after officers mistakenly thought he was driving a stolen vehicle.
The trial is scheduled for May 3 in Harris County 232nd District Court. The case was originally scheduled for Jan.25, but was rescheduled to March 3 and then was set for May 3.
“It might be moved again,” said David Donahue, legal administrator for Cotton’s attorney, Paul Aman. “There is a good possibility it could be put on a two week docket.”
Donahue said there are a couple of cases ahead of the Cotton case, which would push the trial back to a later date.
“We’re kind of not happy,” he said. “We’re ready to go.”
More definite information on whether the case will proceed as scheduled will be known on Monday.
